Written to be read, once, by the person it binds. If any of it is unclear, that is our failure and we would like you to tell us.
1. Who we are
Zagg Pty Ltd (ABN 80 662 135 435), trading as Zagg ("Zagg", "we", "us", "our"), operates the Zagg platform at zagg.app. If anything in these terms is unclear, email hello@zagg.app. Formal notices under these terms may be sent to the same address.
2. Who can hold an employer account
You must be authorised to act on behalf of the company you represent to create and use an employer account, and you must use a work email address. By accepting these terms you represent that you have that authority. One employer account belongs to one company; if your organisation needs more than one user, contact us.
3. What Zagg is, plainly
Zagg is a reverse marketplace. Vetted developers go on the market and choose which companies may approach them. Your company sees an anonymous card for every developer who has chosen you: their experience, skills and how recently they used each, never a name. When you tell us you are interested, the developer's identity is revealed to you the same day and a conversation opens.
3.1 Joining commits you to nothing
Joining Zagg is free and requires no role, no engagement letter and nothing to sign. You may keep a company profile and, if you wish, tell us what you are hiring for. Terms governing a hire are presented to you only at the moment there is a person you want to meet, as section 7 describes.
3.2 There is no shortlist you control
A developer in Selective mode can be seen only by the companies they picked; your company sees such developers only as a count. A developer who has chosen Open mode may be found by any company on Zagg. You cannot otherwise search, browse or request access to developers who have not chosen to be seen by you.
4. What you see, and what you may do with it
Everything you see about a developer through Zagg, before or after their identity is revealed, is confidential and is provided to you solely to evaluate that specific introduction. You must not attempt to identify a developer before their identity is revealed; approach, contact or attempt to recruit a developer outside the platform on the basis of information you saw through it; scrape, copy, export or systematically extract developer information; or disclose developer information to anyone outside your organisation who does not need it to evaluate the introduction. Where a developer has chosen to show their public code, you may view it for that purpose only.
5. The 48-hour window
Once a developer picks your company, you have 48 hours to answer with one of two moves: Interested, or Not right now. If you do not answer within that window, the pick is treated as declined and the developer's identity is never revealed to you for that pick. The developer is told either way.
6. Acceptable use
Do not misuse Zagg. That includes creating more than one account per company without our agreement, giving us false information about your company, attempting to bypass the pick-and-reveal process, or using anything you learn through Zagg to disadvantage a developer who did not pick you.
7. Money
The first time you press Interested, Zagg's Terms of Business are presented to you for one-click acceptance in the same step, and they govern any hire that follows. In short: a fee of 12.5% of the base salary is invoiced on the developer's start date, with a six-month pro-rata guarantee. Nothing in these terms creates a payment obligation; that agreement does.
8. Confidentiality of developer information
Developer information you receive through Zagg is confidential. You must protect it with at least the same care you use for your own confidential business information, and you must not use it for any purpose other than evaluating the specific introduction it relates to.
9. Our promises, and their limits
We aim to run a reliable platform, but we do not promise it will always be available, error-free, or that any introduction will result in a hire. To the fullest extent the law allows, we exclude all warranties other than those the Australian Consumer Law does not allow us to exclude, and our liability to you is limited to resupplying the service or, at our choice, the cost of doing so. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
10. Suspension and termination
We can suspend or close your account if you breach these terms, misuse developer information, or if we reasonably believe your continued access poses a risk to Zagg or to a developer. You can close your account at any time; closing it does not end any agreement already in force under section 7.
11. Changes to these terms
We may publish a new version of these terms. The version you accepted governs your use of Zagg until you accept a new one; if we make a material change, we will ask you to accept the new version before you continue. Every version we have ever published stays readable at its own address.
12. Governing law and disputes
These terms are governed by the law of New South Wales, Australia, and you and Zagg submit to the exclusive jurisdiction of its courts. If you have a dispute with us, please email hello@zagg.app first.
